  I own a restoration business is Birmingham, AL. I partnered with American funding solutions to factor my invoices. I had some outstanding invoices go unpaid and I spoke with Kim and Anna at american funding on May 27th 2021. The agreement was that I settle with them in the amount of $17,500 and my vendor sent them 2 payments. one on june 25 in the amount of $1,477.72, the second payment on july 13th in the amount of $27,231.05 making the total $28,708.77. They were supposed to deduct the $17,500 as we a agreed and return the rest to me. Today I spoke with Anna and she stated that since your amounts owed were higher even though we agreed on the $17,500 we are not giving you any money back. Im asking them to do is the right thing. It doesnt matter what vehicle it comes in train, plane, or car it gets to you. They said since it didnt come by check direct to them they have rights to the money with it coming from my vendor codeblue. I want to resolve this amicably. I also have an email from Kim, stating that I had to wait 2days for funds to settle in there account after I requested they send me my funds. Do the right thing and honor our agreement.

  Bobby, We never agreed to the lesser amount. In fact, we completely disagreed because that amount you offered didn’t even cover the out of pocket amount you owed. You said “take it or leave it.l. As a reminder, we stopped the fees and gave you over 3 years to repay the balance while continuing to finance your business. We were more then fair to you but you decided you didn’t want to repay the balance due. When we had the opportunity to paid in full, we collected the balance due. Sorry you felt it unfair for American Funding to finally be repaid for the money provided to your company interest free for over 3 years, but we wish you all the best.
