  These folks were not my choice for closing but the buyers.....Lawyers held $5,000 in escrow and it was insane how difficult it was to get the release. They kept saying it was released, in the mail - Its now been two weeks and still telling me it will be sent today. That's three times it was sent, Really Get it together!!!!

  Mr. Smart, We are sorry to hear about your experience, but would like to take this opportunity to clarify what took place. Buyers and sellers frequently request that title companies hold funds in escrow after settlement, often for post-occupancy security deposits. We provide this service strictly as a courtesy. We do not release deposits until we are notified by the parties to the transaction that we are to do so. In your complaint you state that you had been waiting for two weeks for your deposit to be released, and had been told multiple times that a check had been placed in the mail. However, our office was not notified by any parties to the transaction that the funds were to be released to you until late in the day on Friday the 6th. The request was passed to our post-closing team on the morning of Monday the 9th. At that point we do have checks and balances that take place before we release funds. In your situation, as was communicated to you already, our office did take time to confirm with other parties that the funds were to be released to you. That process did cause the funds to not be set for release until Tuesday the 10th. On Tuesday, the check was cut to you and was ready to be picked up by our mail carrier on Wednesday as he had already picked up mail on Tuesday. On the morning of Wednesday the 11th we received notice that you were frustrated by the delay in the release of your funds. This was a surprise to us considering the short period of time that had passed since we received the request. Upon research of this issue, we have been informed that the parties who were requesting your funds to be released had not been contacting our office, but in fact had been mistakenly contacting another office that you had worked with. Respectfully, your statement that it took two weeks for the release to be sent is not correct. We had a check ready to be sent to you in two business days. As for the statement that you were informed that your check had been mailed three times, that is also not correct. Our office did not inform anyone of this check being mailed out until we were contacted Wednesday morning. Our typical procedure is for checks to be mailed unless otherwise directed. At that point we did let you know that we could stop the check from being mailed and offered to send a wire to you as a courtesy so that you would receive the funds more quickly. You instead requested the check to be sent to you by FedEx, which we gladly agreed to do as a courtesy and at no additional cost. While we understand and empathize with your frustration that you were repeatedly informed that your check was being mailed out for two weeks, your frustration has been misdirected. Please do not hesitate to contact management to discuss further.
